The offer and sale of products made on the website https://amara.it are governed by these General Conditions of Sale. For any other legal information, please consult the following sections: Privacy Policy. The Customer is required, before submitting its purchase order, to read carefully these general terms of sale. The forwarding of the purchase order implies the full knowledge and express acceptance of both these general conditions of sale and of what is indicated in the Order Form. The Customer is obliged, once the online purchase procedure has been completed, to print and store these general conditions of sale and the relevant order form, already viewed and accepted.

1. Subject

1.1 These General Terms and Conditions of Sale have the object of the sale of products made online through electronic commerce service on the site on https://amara.it. In view of the high number of products available, the main characteristics and prices of the products (including any additional cost) are clearly indicated on the site.
1.2 The products sold on the site can be purchased and delivered exclusively in the countries indicated in the Order Form. Any orders for shipments outside those countries will be automatically rejected during the order processing procedure.

2.2 These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders of products on https://amara.it and do not regulate, instead, the provision of services or the sale of products from entities other than the Seller who are present on https://amara.it via links, banners or other hyperlinks. Before submitting orders and buying products and services from different parties to the Seller, we suggest checking their terms of sale, because the Seller is not responsible for providing services from third parties other than the Seller.

2.3 The products are sold to the Customer identified by the data entered at the time of the compilation and sending of the order form in electronic format with contextual acceptance of these General Conditions of Sale.

2.4 The offers of products on the site https://amara.it are aimed at older customers.
If you are under 18 years old to be able to buy on the site https://amara.it you must first have the consent of one of your parents or a legal guardian.

2.5 The Customer is prohibited from entering false names, and/or invented, and/or fantasy names, in the online order procedure and in further notices. The Seller reserves the right to legally pursue any violation and abuse, in the interest and protection of consumers all.

2.6 By accepting these Terms of Sale, you also exempt the Seller from any liability arising from the issue of incorrect tax documents due to errors related to the data provided by you at the time of placing the online order, being yourself as a customer the only person responsible for their correct insertion.

3. Sales via electronic commerce service

3 By online sales contract we mean the distance contract for the sale of mobile goods (hereinafter Products) stipulated between you, as Client, and Amara, as a Seller, as part of an electronic commerce service organized by the Seller, which, for this purpose, employs remote communication technology called the Internet.

3.2 To conclude the purchase contract of one or more products, you will need to fill out the order form in electronic format (from now on Order) and send it to the Seller through the Internet following the relevant instructions.

3.3 The Order contains:

referral to these General Conditions of Sale; information and images of each product and its price; the means of payment you can use; the delivery methods of the Products purchased and the related shipping and delivery costs; the methods and times of return of the purchased products.

3.4 Amara constantly adopts measures to ensure that the photographs shown on the Site are faithful reproductions of the original products, including the adoption of every technological solution possible to minimize the inaccuracies, some variations are always possible due to the technical characteristics and the characteristics of resolution of the colors used by the computer. Consequently, the Seller will not be responsible for any inadequacy of the graphic representations of products shown on the Site if due to these technical reasons, since these representations have merely an illustrative function.

3.5 Before conclusion of the contract, you will be asked to confirm that you have read the General Conditions of Sale including the Notice on the right of withdrawal and the processing of personal data.

3.6 The contract is concluded when the Seller receives your Order Form through the Internet, after checking the correctness of your order data.

3.7 The language available to conclude the contract with the Seller is Italian and the applicable law is Italian.

3.8 After the contract is concluded, the Seller will take over your Order for its escape.

4. Order Examination

4.1 With the transmission through the Internet of the Order, you agree unconditionally and you are committed to observing, in relation to the Seller, these General Terms of Sale.

4.2 After the contract is concluded, the Seller will send you, by e-mail, an Order Confirmation, containing a summary of the information.

4.3 Stay still the possibility, by the Seller, before sending the Order Confirmation, to request you by e-mail or by phone indicated by you, further information with reference to the Order you sent through the Internet.

4.4 The Seller may not give you purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailable products. In these cases, we will inform you by e-mail that the contract is not concluded and that the Seller has not followed your Order by specifying its reasons. In this case, the sum previously committed on the means of payment of the Customer will be unpaid.

4.5 If the products, presented on the website, are no longer available or for sale after sending the order, the Seller will notify you, promptly and in any case within thirty (30) working days from the day after the day when you have sent your order to the Seller, the eventual unavailability of the Products ordered. In this case, the sum previously committed on the means of payment of the Customer will be unpaid.

4.6 Each sale carried out by the Seller through the online sales service may cover one or more products, without limit of quantity for each item.

4.7 Amara reserves the right to refuse orders from a customer with whom a legal litigation relating to a previous order is in progress. This applies equally to all cases where Amara refer to the customer, including, for example, the case of prior violations of contract conditions for online purchase on the Site or for any other legitimate reason, especially if the customer has been involved in fraudulent activities of any kind.

4.8 Amara reserves the right in case of payment received by bank transfer, to wait for the order to expire, the actual receipt of the order. At that time the order will remain waiting. The day after receiving the transfer the order will be processed and processed.

5. Sale prices

5.1 Unless otherwise stated, all prices of the Products and shipping and delivery costs indicated on the website and in the Order are to be considered VAT included and expressed in Euro. The validity of the prices indicated is always and only that indicated by the website at the time of transmission of the Order through the Internet. The prices of the Products and shipping and delivery costs may vary without notice. Then make sure of the final sale price before submitting the relevant Order.

5.2 All Products are shipped directly from Italy. The prices of the Products and shipping and delivery costs indicated on the website and in the Order, if not specified otherwise, are to be considered not inclusive of any costs related to customs duties and related taxes, not previously calculated, if the shipment takes place in non-EU countries or in countries where the current legislation provides import charges. In this case, the existence of any additional costs mentioned above will be clearly mentioned during the insertion and revision of the Order, provided that the precise amount of these costs will be communicated by the Carrier to the Customer at the time of delivery of the products.

5.3 These costs are then borne by the Customer and must be paid directly at the time of delivery of the Products, according to the indications specified in the Order Confirmation.

6. Payment methods

For the payment of the price of the Products and the related shipping and delivery costs you can follow one of the methods indicated in the order form of the site https://amara.it and that below are summarized.

6.1 Credit cards and prepaid cards.

6.1.1 For online orders on our website we accept payment either by credit card or by prepaid cards (for example, PostePay) without any additional charge on the cost of the product and shipping. It is understood that you must hold a valid credit card at the time of the order of the Products purchased online and that the name on the credit card must be the same indicated on the billing data. In the absence of such assumptions it will not be possible to proceed with the order. 6.1.2 If, once you have received the parcel with your order, for any reason you intend to make use of the right of withdrawal as a result of the payment of the Products purchased online, the Seller will charge the bank to credit the amount to be refunded directly on your credit card.

6.2 Paypal.

6.2.1 If you have a Paypal account, Amara gives you the possibility to make payments using directly email and related password with which you registered on www.paypal.com.

6.3 Bank Transfer

6.4 Mark with relative surcharge specified in the order.

6.5 At no time of the purchase procedure Amara is able to know the information about your credit card (for example, the credit card number or the date of its expiry), transmitted via secured connection by encrypted protocol directly to the subject's website that manages electronic payment (bank or Paypal). No Seller's computer archive will retain such data.

6.6 In no event can the Seller be held responsible for any fraudulent and undue use of credit cards and prepaid by third parties.

7. Shipping and delivery of products

7.1 Each shipment contains:

i/products/or ordered; the relative document of transport/accompanying invoice/documents and indications useful to the return; any informative and marketing material.

7.2 The delivery of the Products purchased through the Seller's website can take place in different ways.

7.3 Customer home delivery

7.3.1 The products purchased will be delivered by the courier identified by the Seller at the shipping address indicated by the Customer on the Order with insured shipment. 7.3.2 When receiving the goods at home, we ask you to verify the integrity of the packages at the time of delivery by the courier. In case of anomalies you will have to detect and write exactly the same from the courier and reject the delivery. Otherwise you will be able to assert your rights in this regard.

7.4 Delivery at agreed point of sale and withdrawal by customer

8. Right of withdrawal

8.1 Only if the Customer who enters the contract is a Consumer (by means of this definition any natural person acting on the site for purposes outside the business or professional activity, if necessary), will have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, by communicating it to the Seller within the period 14 (QUATTORDICI) days, decorated from the day on which the Customer or a third party, designated by the Seller. The term shall be respected if the Customer sends the goods before the expiry of the period of 14 days. We remind you that, as provided for in the current legislation, the right of withdrawal is excluded and cannot therefore be exercised in case the products you purchased have been customized on your explicit request at the time of placing the Order.

8.2 To exercise the right of withdrawal you have the following possibilities:

8.2.1 Fill out the Form of Reso received within the parcel with the delivery of the products within the period of 14 (QUATTORDICI) days from its receipt, you can follow the instructions and communicate to us the will to withdraw from the contract, reporting what Products will be returned. 8.2.2 As an alternative to the above, you can also submit any other explicit declaration of your will to exercise the right of withdrawal or contact us to [email protected].

8.3 Upon filling out the Return Form, you will receive all the information necessary for the return of the Products by requesting the Seller to collect the parcel to make.

8.4 The right of withdrawal is subject to the following conditions:

the Products rendered must be returned in their entirety and not on parts or components of them even in the case of kits; the Products rendered must not be used, worn, washed or damaged; returned Products must be sent to the Seller in one shipment. The Seller reserves the right not to accept Products of the same Order made and sent at different times; the right of withdrawal may also be exercised with the return of only some of the products purchased: in this hypothesis the price will be recalculated taking as reference the price normally used for the purchase of the individual product. In all other hypotheses (e.g. combined sales, premium operations etc.) the right of withdrawal may be exercised only with the return of all the Products subject to the purchase, thus excluding any partial exclusion.

8.5 If the right of withdrawal is exercised by you in accordance with the previous conditions, the Seller shall refund the sums paid by the customer no later than 14 days from the day on which the Seller has already received the return of the goods. The Seller will re-credit the refund by bank transfer on the current account entered in the return form compiled by the applicant.

8.6 In case of withdrawal, the only expenses you pay will remain those initial shipments of the order of the products purchased, and any expenses of mark. All other expenses will be refunded by the Seller, including the delivery costs of the goods made following the exercise of the right of withdrawal (with the exception of the additional costs arising from your choice of using a different and more expensive delivery mode than the standard delivery type offered by the Seller).

8.6.1 In case of withdrawal for purchase of items on balance or promotion, the cost of the return shipment is borne by the buyer. This amount is €8 and will be deducted from the total amount made.

8.7 Amara undertakes to also bear the initial shipment costs of the Products exclusively in case of damage to the same due to the transport or errors in the shipment by the Seller himself. Only in these cases will the Seller also refund the amount you paid for shipping.

8.8 For the return you will need to use only the Corriere indicated by the Seller: in this way, you will not have to pay the costs to you for the return of the purchased products because this payment will be made, on your behalf, directly by the Seller. Subsequently, the Seller, except for the previous point 8.7 and for the cases of return by product defect, will deduct from the refund to you due to a forfeit amount equal to the cost previously incurred by you for the shipment and delivery to your domicile of the purchased products or the shipping costs normally provided. Moreover, from the time of delivery of the products purchased to the shipper indicated by the Seller, the Seller will exempt you from any liability in case of loss or damage of the products during transport.

8.9 The delivery option of the products is not provided at one of our agreed sales points.

8.10 In case of exercise of the right of withdrawal, the Seller will provide the corresponding refund by crediting the amount with the method of bank transfer on the current account as provided by the customer in the Return Form attached to the parcel received by the Seller.

8 In the case of exercising the right of withdrawal without compliance with the above mentioned modalities (e.g. more than 14 days provided, or without filling out the Return Form attached to the products in the received package), the Seller will send you back the Products purchased by charging you with additional shipping costs.

9. Non-conform product warranty

9.1 The Seller is responsible for any defect of the products offered on the site, including the non-compliance of the items ordered, in accordance with the provisions of Italian law.

9.2 All return costs for defective products will be incurred by the Seller.

13. Applicable law, dispute settlement and jurisdictional forum

1 These General Conditions of Sale are governed by Italian law and will be interpreted according to it, subject to any different prevailing mandatory norm of the country of habitual residence of the Customer. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law and any disputes inherent and/or consequent to them must be resolved exclusively by the Italian judicial authority. In particular, if the Customer is qualified as a Consumer, any disputes shall be resolved by the court of the place of residence or residence of the Customer under the law.

14. Edit and update
